NAA Click & Lease Updates ,


The NAA Click & Lease Program for South Carolina will be updated on January 13, 2021 to include the following changes to your lease forms. The Release Notes, which are accessible when logged into your NAA Click & Lease Program, include copies of these upcoming forms.  

Should you have any questions about these changes, please contact NAA.  As always, we recommend you and your local legal counsel review all new and/or updated forms before implementing them into your leasing operations.

Updated Forms:

  1. Apartment Lease Contract
    1. Paragraph 6 – Rent and Charges
      1. Language relocated from Paragraph 31 – Default by Resident: IF YOU DO NOT PAY YOUR RENT ON TIME WHEN REQUIRED BY THIS LEASE CONTRACT: This is your notice. If you do not pay your rent within five days of the due date specified in this Lease Contract, we can start to have you evicted without further notice. You will not receive any further notice or warnings as long as you live in this rental unit, unless we decide to provide them to you as a gratuity, not as a right.
    2. Paragraph 13 – Failing to Pay First Month’s Rent 
      1. Language modified: If you don’t pay the first month’s rent when or before the Lease Contract begins, we also may end your right of occupancy and recover actual damages, future rent, reletting charges, attorney’s fees, court costs, and other lawful charges, to the extent provided by law. Our rights and remedies under paragraphs 11 (Early Move-Out) and 31 (Default by Resident) apply under this paragraph.
    3. Paragraph 31 – Default By Resident 
      1. Sub-paragraph removed: Acceleration. To the extent provided by law, all monthly rent for the rest of the lease term or renewal period will be accelerated automatically without notice or demand (before or after acceleration) and will be immediately due and delinquent if, without our written consent: (1) you move out, remove property in preparing to move out, or give oral or written notice (by you or any occupant) of intent to move out before the lease term or renewal period ends; and 2) you’ve not paid all rent for the entire lease term or renewal period. Such conduct is considered a default for which we need not give you notice. Remaining rent also will be accelerated if you’re judicially evicted or move out when we demand because you’ve defaulted. Acceleration is subject to our mitigation obligations below. 
      2. Language modified under sup-paragraph - Other Remedies: If your rent is delinquent, we may terminate your tenancy upon written notice to you of nonpayment and intent to terminate your tenancy.
    4. Paragraph 34 – No Waiver 
      1. Language modified: Our not enforcing or belatedly enforcing written-notice requirements, rental due dates, liens, or other rights isn’t a waiver under any circumstances. 
    5. Paragraph 46 – Move-Out Procedures 
      1. Language modified: Early move-out may result in reletting charges under paragraphs 11 (Early Move-Out) and 31 (Default by Resident), to the extent provided by law. 
    6. Paragraph 49 – Security Deposit Deductions and Other Charges
      1. Language removed: “…accelerated rent if you have violated paragraph 31 (Default by Resident)…”
  2. Student Housing Lease
    1. Paragraph 1 – Parties 
      1. Language removed:  The terms “you” and “your” refer to the resident listed above, and a person authorized to act on behalf of a resident in the event of that resident’s death or incapacity.
    2. Paragraph 5 – Security Deposit 
      1. Language removed: “…accelerated rent if you have violated paragraph 31 (Default by Resident)…”
    3. Paragraph 10 – Rent and Charges

      1. Language modified:  MONTHLY RENT. Your total monthly rent for the items checked in Paragraph 3 above will be $_____. The monthly animal rent is due on the 1st day of each month with no grace period.
    2. Paragraph 6
      1. Language added:  Unless otherwise designated as a vehicular charging station, you are prohibited from charging electrical vehicles in any garage outlets or in any outdoor outlets located on the property.


How will the users experience within the NAA Click & Lease be affected?
The following changes will be implemented within the NAA Click & Lease Program in correlation to the form revisions.

  • Animal Addendum. Two fields will be removed from the “Animal Addendum” section of the lease editor.

Enclosed Garage Addendum. Two fields will be removed from the “Animal Addendum” section of the lease editor.
